We are usually instructed on behalf of the NHS Health Litigation Authority, which represents the NHS insurers defending a claim of negligence brought by a complainant. Instructions usually revolve around the nature and extent of any psychological, neuro-psychological or physical disability arising from any such negligence; whether or not psychological assessment and/or treatment delivered was appropriate; the impact of any disability upon the person’s functioning and life choices (work, independence, family, longevity) both now and in the future, and on-going therapy and/or care and support that the person may require to minimise the impact of the consequences of the negligence. In most cases liability has been admitted. We occasionally accept instructions on behalf of the complainant.
